1. What we provide
We build you a website on one of our templates, using the content you give us through the questionnaire, and we host and look after it under the care plan.
Everything included in the build and the care plan is listed on the What's included page. Anything not listed there is quoted separately.
With the Online shop package we also set up a WooCommerce shop on your site. You are the seller to your customers: their payments go straight to your own Stripe account, and your shop's shipping and returns pages are built from our templates and the choices you confirm.
2. Price, GST and payment
The build price and the care plan price are shown on our site and again before you pay, each with the GST-inclusive figure and, for the care plan, the full minimum-term total.
Your first payment is the build price plus your first month of the care plan. The care plan is then billed monthly. Payments are taken by Stripe by card or BECS direct debit. We never see or store your card or bank details.
3. How soon your site goes live
A website goes live within 5 business days from content received. An online shop goes live within 10 business days from content received. The clock starts when you lock your content in the questionnaire. Business days are Monday to Friday, excluding New South Wales and national public holidays. We tell you the go-live date as soon as the clock starts.
If your website is not ready to go live within 5 business days from content received, or your online shop within 10 business days from content received, for a reason that is ours, your first month of the care plan is free. The clock pauses while we wait for something only you can supply (for example, access to a domain you already own, or approval of the connection to your Stripe account).
4. Your content and the rounds of changes
You are responsible for the accuracy of your business details, your claims about your services, your licence and registration numbers, and any photos or logos you upload. You confirm you have the right to use them.
Draft copy we write for you is a starting point. You check it before launch. You get three rounds of changes: you leave comments on your preview, we make the changes, and you can do this up to three times before you approve the site for launch. We aim to return each round of changes within two business days of receiving it. That is a target, not a guarantee, and it is separate from the 5 business days from content received in section 3. Changes beyond the rounds included are not part of the fixed price; we quote them before we start, and after launch your care plan covers edits.
If you are a registered health practitioner, you are responsible for your site meeting the advertising requirements that apply to your profession. Our templates avoid testimonials and claims about outcomes, and we will not add them.
5. The care plan, minimum term and cancellation
The care plan has a minimum term of [minimum term, JP decision], shown with the price before you pay. After the minimum term it continues month to month.
You can cancel online from your account at any time. If you cancel during the minimum term, the exit fee is 50% of the care plan fees for the months of the minimum term remaining after the current month, and it never exceeds the remaining months of the minimum term.
The care plan does not renew into a new fixed term. If we increase the care plan price, we give you at least 30 days' notice and you can cancel before the increase applies without an exit fee.
6. You own your site and your domain
Your domain is registered in your name and ABN. Your website is a standard WordPress site. When your care plan ends, we give you a complete copy of your site and transfer your domain to a registrar of your choice. We keep nothing back.
We retain the rights in our templates, our code and our tools. You have a permanent licence to use them as part of your site.
7. Hosting
Your site is hosted in Australia. We take backups, apply updates and monitor security as part of the care plan. We aim for your site to be available at all times, but we cannot promise uninterrupted service; where a problem is ours we fix it as a priority.
8. Acceptable use
Your site may not be used for anything unlawful, misleading or harmful, and must not infringe anyone else's rights. We may take a site offline if it is used that way, and we will tell you why.
9. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those guarantees. For anything else, our liability is limited, where the law allows, to supplying the service again or paying the cost of having it supplied again.
10. Changes to these terms
We may update these terms. The version you accepted applies to your order. If a change affects your care plan, we give you at least 30 days' notice, and you can cancel before it applies without an exit fee.
11. Third-party content and data
Our suburb list is derived from the GeoNames postal code dataset (geonames.org), used under the Creative Commons Attribution 4.0 licence.
Photos we supply are licensed for use on your site. Booking systems (Cliniko, Halaxy, Nookal) are provided by those companies under their own terms.
13. Clients in New Zealand
If your business is in New Zealand, these terms apply with the changes in this section. Prices are in New Zealand dollars. No GST is charged: we are an Australian business, trading under our Australian ABN, and our services to you are an export of services. Payment is by card through Stripe.
The Fair Trading Act 1986 applies to what we tell you about our service. Nothing in these terms limits a right you have under that Act that cannot be limited.
The Consumer Guarantees Act 1993 applies to our services unless you are acquiring them in trade, which a business buying a website for its own business normally is. Where you acquire our services in trade, we both agree that the Consumer Guarantees Act 1993 does not apply, and that sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 do not apply, to the extent permitted by section 43 of the Consumer Guarantees Act 1993 and section 5D of the Fair Trading Act 1986, and we agree that this is fair and reasonable.
The 5 business days from content received are New Zealand business days: Monday to Friday, excluding New Zealand public holidays and your region's anniversary day.
A .nz domain we register for you is registered in your name, under the .nz rules, and you hold it.
